1. Promoter
The promoter of this programme is AgaMatrix Europe Limited registered in the United Kingdom with offices at Harwell Innovation Centre, 173 Curie Avenue, Harwell, Oxford, Oxfordshire, OX11 0QG (“AgaMatrix”).
2. Scope and Eligibility
The title of the programme is “The ALLYcgm Free Trial Programme” (the “Programme”). Eligible individuals may receive one (1) free ALLYcgm sensor in accordance with these Terms and Conditions (“T&Cs”). Subject to stock availability. The Programme is available for new customers aged 18 years or over living in the United Kingdom who have not used or tested ALLYcgm previously. Individuals must have a mobile device compatible with the ALLYcgm app. By submitting a claim to enter this programme you confirm that you are eligible to claim one (1) free ALLYcgm sensor and understand that AgaMatrix may require proof of eligibility and identity to prevent fraudulent activity. AgaMatrix will not accept claims that do not comply with the eligibility criteria or where the individual has previously received an ALLYcgm sensor. There is a limit of one (1) free sensor per person and entries on behalf of another person will not be accepted. AgaMatrix reserves the right to disqualify claims that are contrary to the intent or spirit of the Programme. Such actions may be considered fraudulent and AgaMatrix reserves the right to withhold the relevant sample and/or report these activities to law enforcement and/or pursue legal action.
3. Participation
The offer requires eligible individuals to sign-up to the ‘monthly subscription with free trial’ ALLYcgm subscription offer. At sign-up customer payment details are required but no money is taken. Once the order is confirmed one ALLYcgm sensor is dispatched. 15-days after the order is confirmed you will be billed £80.00 and two further sensors will be dispatched. 30 days later, and each 30 days thereafter, a further £80.00 will be charged and a further two sensors will be dispatched. This process, the ‘monthly subscription’, will continue until you choose to cancel. If you are not completely satisfied with your ALLYcgm trial sensor you may cancel your subscription within the first 14 days of placing your order and you will not be charged. Once a payment has been processed it is non-refundable, unless you are making a claim under our warranty policy. There will be no cash alternative for the free sample.
To cancel your subscription, you can do this at anytime by logging into ‘My account’ > Subscriptions. You will see conformation of this when you confirm changes and refresh your browser page.
4. Prohibition on Resale and Distribution
You undertake not to resell or distribute the free trial ALLYcgm sensor under any circumstances. Unauthorised resale constitutes a breach of these T&Cs and AgaMatrix reserves the right to claim the current recommended retail price of the ALLYcgm sensor from you and/or pursue legal action. AgaMatrix reserves the right to report any suspected fraudulent activity, including unauthorised multiple free trial requests, counterfeit information supplied, or identity theft to law enforcement and pursue legal action as necessary. In the event of a breach of these T&Cs AgaMatrix may seek damages.
5. Your data and terms of use
Participants agree to have their data processed in accordance with the AgaMatrix Privacy Policy and to abide by the ALLYcgm terms of use.
6. Programme Availability
AgaMatrix reserves the right to revoke, void, cancel, suspend or amend the Programme at any time and without warning. AgaMatrix is not liable for any disruption to this Programme for reasons beyond its reasonable control. In the event of disruption AgaMatrix will use reasonable endeavours to resolve the issue and resume the Programme fairly. Additionally, AgaMatrix accepts no responsibility for sample orders that are lost, mislaid, damaged, or delayed in transit, regardless of cause.
7. General
To the extent permitted by law AgaMatrix, its agents, or distributors are not liable for any loss, damage, personal injury, or death resulting from the use of the free trial sensor, except when caused by AgaMatrix’s negligence. Your statutory rights are not affected.
8. Governing Law and Jurisdiction
This Programme is governed by the laws of England and Wales, and participants submit to the exclusive jurisdiction of the courts of England and Wales.
